1. Introduction and Acceptance

Welcome to paintvqfr B.V. ("paintvqfr", "we", "us", "our"). These Terms of Service ("Terms") govern your use of our bicycle tour services, website, and related offerings. By booking a tour, using our website, or engaging with our services, you agree to be bound by these Terms.

paintvqfr B.V. is a company registered in the Netherlands with registration number 41963402, VAT number NL549625207B02, and registered address at Molenweg 115, 4880 CS Breda, North Brabant, Netherlands.

If you do not agree to these Terms, please do not use our services or website.

2. Services Offered

paintvqfr provides bicycle tour services throughout the Netherlands, including but not limited to:

• Guided countryside bicycle tours
• Historic city cycling experiences
• Multi-day cycling holidays
• Custom group tours and corporate events
• Bicycle rental services
• Additional services such as culinary experiences and photography tours

All services are subject to availability and may be modified or cancelled due to weather conditions, safety concerns, or other circumstances beyond our control.

3. Booking and Payment Terms

3.1 Booking Process

• Bookings can be made through our website, email, or telephone
• A booking is confirmed only upon receipt of payment and written confirmation from paintvqfr
• We reserve the right to refuse any booking at our discretion
• All participants must provide accurate personal information

3.2 Payment Terms

• Full payment is required at the time of booking for tours under €500
• For tours over €500, a 50% deposit is required with the balance due 14 days before the tour
• We accept major credit cards, bank transfers, and other payment methods as specified
• All prices are in Euros and include applicable VAT
• Prices are subject to change without notice until booking is confirmed

3.3 Group Bookings

Special terms may apply to group bookings of 10 or more participants. Contact us for custom pricing and payment arrangements.

4. Cancellation and Refund Policy

4.1 Cancellation by Customer

We may cancel tours due to:

• Severe weather conditions or safety concerns
• Insufficient bookings (minimum 4 participants for most tours)
• Force majeure events
• Equipment failure or other operational issues

In such cases, you will receive a full refund or the option to reschedule at no additional cost.

4.3 Refund Processing

Approved refunds will be processed within 14 business days to the original payment method.

5. Participant Requirements and Responsibilities

5.1 Age and Fitness Requirements

• Participants must be at least 12 years old unless specified otherwise
• Children under 16 must be accompanied by an adult
• Participants should have basic cycling ability and reasonable fitness
• Medical conditions that may affect participation must be disclosed

5.2 Participant Conduct

Participants must:

• Follow all safety instructions and guidance from tour guides
• Wear provided safety equipment (helmets, reflective vests)
• Arrive punctually at designated meeting points
• Respect local communities, environment, and other participants
• Refrain from behaviour that may endanger themselves or others
• Not participate under the influence of alcohol or drugs

5.3 Equipment and Personal Belongings

• Bicycles and safety equipment are provided by paintvqfr
• Participants are responsible for personal belongings
• Damage to equipment due to misuse may result in charges
• We recommend bringing weather-appropriate clothing

6. Safety and Risk Acknowledgment

6.1 Inherent Risks

Bicycle touring involves inherent risks including but not limited to falls, collisions, mechanical failures, and adverse weather conditions. By participating, you acknowledge and accept these risks.

6.2 Safety Measures

• All tours are led by trained and certified guides
• Safety equipment is provided and must be used
• Routes are carefully planned to minimize risks
• Emergency procedures are in place
• Comprehensive insurance coverage is provided

6.3 Medical Conditions

Participants with medical conditions, injuries, or concerns should consult their physician before participating and inform paintvqfr of any conditions that may affect their safety or the safety of others.

7. Limitation of Liability

7.1 General Limitations

To the fullest extent permitted by Dutch law, paintvqfr's liability for any claims arising from or related to our services is limited to the amount paid by the participant for the specific tour or service.

7.2 Excluded Damages

We are not liable for:

• Indirect, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Personal injury or property damage due to participant negligence
• Delays or cancellations due to force majeure events
• Actions of third-party service providers

7.3 Insurance Coverage

All tours include comprehensive activity insurance. Participants are encouraged to obtain personal travel insurance for additional coverage.

8. Intellectual Property

8.1 paintvqfr Property

All content on our website, marketing materials, and tour routes are the intellectual property of paintvqfr and are protected by applicable copyright and trademark laws.

8.2 Photography and Media

• paintvqfr may take photographs and videos during tours
• By participating, you consent to the use of your likeness in promotional materials
• You may opt out of photography by informing your guide
• Participants retain rights to their own photographs and videos

8.3 Prohibited Uses

You may not reproduce, distribute, or use our intellectual property for commercial purposes without written permission.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using our services, you consent to the collection and use of information as described in our Privacy Policy.

10. Force Majeure

paintvqfr shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:

• Natural disasters, severe weather conditions
• Government actions, regulations, or travel restrictions
• War, terrorism, civil unrest
• Pandemics or health emergencies
• Infrastructure failures or transportation disruptions

In such events, we will make reasonable efforts to provide alternative arrangements or refunds as appropriate.

11. Modifications to Services and Terms

We reserve the right to modify tour itineraries, routes, or services as necessary for safety, operational, or other legitimate reasons. Significant changes will be communicated to participants in advance.

These Terms may be updated from time to time. Material changes will be posted on our website and communicated to customers. Continued use of our services constitutes acceptance of modified Terms.

12. Dispute Resolution

12.1 Informal Resolution

12.2 Governing Law and Jurisdiction

These Terms are governed by Dutch law. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts in Breda, Netherlands.

13. Severability

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and paintvqfr regarding the use of our services and supersede all prior agreements and understandings.
